Terms of Service

These terms are the agreement between you and SMZD when you use SMZD: smzd.io, the app at samizdat.app, and the sites you publish with it. By creating an account you agree to them. How we handle personal data is in the Privacy Policy.
The service
SMZD lets you write, publish and run websites: documents and comments, hosting, a CMS for each site, newsletters and memberships, forms, search insights and AI features. What each plan includes, and what is paid from prepaid credits, is on the pricing page. SMZD is changing quickly; we may add, change or remove features, and we tell you before we remove one you pay for.
Your account
You need to be at least 16 to use SMZD. Keep your email account safe: anyone who can read it can sign in to SMZD as you. You are responsible for what happens in your account and in the workspaces you run, including what the people you invite do there.
Your content
What you write, upload and publish is yours. SMZD claims no ownership of it. You give SMZD only the permission needed to run the service: to store your content, copy it between our servers, show it to the people you share it with, publish it where you tell us to, and send it to an AI model when you use an AI feature on it. That permission ends when you delete the content, except for copies a reader already has. Your domains stay registered to you.
What you may not do
Do not use SMZD to break the law, to publish what you have no right to publish, to send spam, to spread malware or phishing, to harass people, or to attack or overload SMZD or anyone else. If you do, we may remove the content and suspend the account. Unless the harm is serious or the law forbids it, we tell you first and give you the chance to fix it.
AI features
AI features can be wrong, and they can produce text or pictures that resemble existing work. Read what they make before you publish it; you are responsible for what you publish.
Payments
Polar sells SMZD plans and credits to you as merchant of record, so Polar's checkout terms also apply to each payment, and Polar handles taxes, receipts and refunds. Plans are billed monthly and renew until you cancel. You can cancel at any time; the plan runs to the end of the month you paid for. Every plan comes with a 60-day money-back guarantee: write to us within 60 days of your first payment for a full refund.
If a payment fails or prepaid credits run short, sites that depend on it are paused after a grace period. Paused sites stop being served, but nothing in them is deleted, and they come back once the payment is made.
Leaving
You can leave at any time. Download your documents and export your members, subscribers and form entries first, then write to support at samizdat dot appto delete your account. If we end the service, or end your account for a reason other than a breach of these terms, we give you at least 30 days' notice to take your content with you.
Availability
We work to keep SMZD and your sites online, but we cannot promise they never go down, and we offer no uptime guarantee. SMZD runs on other companies' infrastructure, listed in the Privacy Policy, and their outages can affect it.
Liability
SMZD is provided as it is. As far as the law allows, SMZD is not liable for indirect losses, such as lost profits, lost revenue or lost data, and its total liability to you is limited to what you paid SMZD in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or injury caused by negligence, or takes away rights consumer law gives you where you live.
Changes to these terms
When we change these terms, we update this page and the date at the top. For a change that affects you, we email you at least 30 days before it takes effect. If you do not agree, you can leave before then.
Law
These terms do not yet name a governing law. Until they do, the consumer protection law of the country you live in applies to you.
